Gay Spouses Entitled to Social Security Suvivor Benefits

When a gay couple who had been together for over forty years got married in when gay marriage was finally legal, they were not covered by SS benefits until nine mouths after the wedding. Sadly, one partner died within six months, and the other got no benefits until a class action was filed in a Federal Court which ruled that since the couple had been denied by (a now illegal) law before their marriage, the survivor was entitled to the same benefit that straight people have been enjoying for nearly a century. More's the reason for gay men to marry. The nine month rule still is in place if you marry now, and the survivor must be over 61. To be sure, check with Social Security for details, but now more than ever is a reason for gay couples to tie the knot ASAP.
